Members are solely responsible for everything contained in their own Virtual Memorial/Obituary. Online-Funeral does not verify, endorse or otherwise vouch for the contents of any Virtual Memorial/Obituary. Members may be held legally liable for the contents of their Virtual Memorial/Obituary Pages and may be held legally accountable if their Virtual Memorial/Obituary pages include, for example, defamatory comments or material protected by copyright, trademark, patent or trade secret law without the express permission of the author or owner. 3.The member agrees to indemnify and hold harmless Online-Funeral for any loss, liability, claim, damage, and expenses (including reasonable lawyer's fees) arising from or in connection with the contents of the member's Virtual Memorial/Obituary. 4.Have attained the legal age of consent, that am entitled to enter into legal agreements and I agree to contract with Online-Funeral on all of the terms set out on all legal notices on the Online-Funeral website. 5.Assume full responsibility for all information delivered to Online-Funeral and I further agree that Online-Funeral including any of its directors, officers, employees, affiliates, associates or agents shall not in any way be held liable for information I have delivered to Online-Funeral. **************************************************************** This Agreement shall be treated as though it were executed and performed in Toronto, Ontario, Canada and shall be governed by and construed in accordance with the laws of the Province of Ontario (without regard to conflict of law principles). Other Rights Reserved Online-Funeral also reserves the following rights: To amend or change the Online-Funeral Content Guidelines or Terms of Service at any time and without notice; To release current or past member information if Online-Funeral believes that a member's account is in violation of the Online-Funeral Content Guidelines or Terms of Service, is being used to commit unlawful acts, if the information is subpoenaed and/or if Online-Funeral deems it necessary and/or appropriate; To deny membership to serious or repeat offenders of the Online-Funeral Content Guidelines or Terms of Service; To remove members for conduct that Online-Funeral believes is harmful to other members, to non-members or to Online-Funeral as a business; To utilize third parties to provide services to Online-Funeral members. These third parties may require limited access to members' personal identifying information in order to perform the services; To use images of Virtual Memorial/Obituary pages for promotional and other commercial purposes.
